How to Legally Pass Credit Card Processing Fees to Customers

By VendorCalcs Research Team โ€ข

Executive Summary & Legal Safeguards

  • โœ“ Never Surcharge Debit Cards: Federal law (Durbin Amendment ยง 1075) strictly prohibits surcharging debit cards, even when run as "credit" without a PIN.
  • โœ“ Card Brand Surcharge Cap: Visa and Mastercard cap maximum credit card surcharges at your actual cost of acceptance or 3.0%, whichever is lower.
  • โœ“ Cash Discounting Is 100% Legal Everywhere: Listing standard credit prices and offering a discount for cash, ACH, or check is federally protected in all 50 US states.
  • โœ“ Reverse Invoicing Math: Adding 3% to your invoice does NOT cover a 3% fee. You must divide by (1 - fee rate) to net your exact target.

The 3 Ways Merchants Pass Processing Costs

1. Credit Card Surcharging

A surcharge is an explicit additional fee added at checkout when a customer chooses to pay with a credit card.

  • Where it is legal: Most US states permit surcharging, following Supreme Court rulings that overturned blanket bans on commercial free speech grounds (e.g., Expressions Hair Design v. Schneiderman).
  • Disclosure Requirements: You must post clear signage at the physical entrance and checkout counter (or digital notice on your checkout page) stating the exact percentage fee before payment is taken.

2. Cash Discounting

Unlike a surcharge, cash discounting sets the "regular" shelf price at the credit card rate and offers a discount (e.g., 3%) if the customer pays via cash, check, or direct ACH bank transfer. Because no fee is added to the posted price, cash discount programs are legally compliant across all 50 states without card brand notification filings.

3. Convenience Fees

A convenience fee is a flat fee charged for the privilege of paying through an alternative payment channel outside the merchant's normal business practice (e.g., paying tuition or utility bills online rather than by mail or in person).

The Reverse Invoicing Mathematical Mistake

Thousands of freelancers, agencies, and B2B merchants make a fundamental mathematical error when passing processing fees.

The Mistake: If your project costs $1,000 and Stripe charges 2.9% + $0.30, you might think adding $29.30 results in $1,029.30.
However, Stripe calculates 2.9% on the new total ($1,029.30), charging $30.15. Your net payout is only $999.15. You lost money!

// The Correct Reverse Formula:
Required Gross = (Target Net + Fixed Fee) / (1 - Percentage Rate)
// For $1,000 net on Stripe US (2.9% + $0.30):
Required Gross = (1000 + 0.30) / (1 - 0.029) = $1,030.18
